Environmental Impact Assessment is a decision-making system designed to help development and environmental protection coexist.

환경영향평가 제도는 개발과 환경보전이 공존할 수 있도록 돕는 사회적 의사결정 제도이다.


연구의 출발점

나의 연구는 환경영향평가 제도(Environmental Impact Assessment System)에서 시작되었다.

환경영향평가는 개발사업이 환경에 미칠 수 있는 영향을 사전에 조사·예측·평가하고, 그 결과를 사업계획과 의사결정에 반영하기 위한 제도이다. 처음에는 환경영향을 보다 과학적으로 조사하고 평가하는 방법에 관심을 가졌다. 그러나 제도를 공부할수록 환경영향평가는 단순한 기술적 평가 절차가 아니라는 사실을 깨닫게 되었다.

아무리 정확한 조사와 예측이 이루어지더라도, 그 결과가 의사결정 과정에 제대로 반영되지 않는다면 환경영향평가의 목적을 충분히 달성하기 어렵다. 또한 사업자와 행정기관, 전문가, 주민과 시민단체가 정보를 공유하고 의견을 나눌 수 없다면 갈등은 반복될 수밖에 없다.

따라서 환경영향평가의 실효성을 높이기 위해서는 과학적인 조사뿐 아니라 대안의 검토, 정보공개, 주민참여, 그리고 투명한 의사결정 절차가 함께 마련되어야 한다.

이러한 문제의식은 환경영향평가 제도 자체에 관한 연구에서 주민참여, 환경 NGO, 사회적 합의형성, 그리고 주민수용성에 관한 연구로 관심을 확장시키는 출발점이 되었다.

The Beginning of My Research

My research began with the Environmental Impact Assessment System.

Environmental Impact Assessment is an institutional process for investigating, predicting, and evaluating the potential environmental impacts of development projects and incorporating the findings into project planning and decision-making. At first, I was mainly interested in how environmental impacts could be assessed more scientifically. As I studied the system more closely, however, I came to realize that EIA was not merely a technical evaluation procedure.

Even when environmental impacts are investigated accurately, the purpose of EIA cannot be fully achieved unless the findings are properly reflected in decision-making. Conflicts are also likely to continue when project proponents, government agencies, experts, residents, and civil society organizations do not have sufficient opportunities to exchange information and express their views.

An effective EIA system therefore requires more than scientific investigation. It must also include the examination of alternatives, access to information, public participation, and a transparent decision-making process.

This understanding became the starting point from which my research expanded from the EIA system itself to Public Participation, Environmental NGOs, Consensus Building, and Social Acceptance.

스코핑에 주목한 환경영향평가제도의 국제비교연구

An International Comparative Study of Environmental Impact Assessment Systems with a Focus on Scoping

연구 배경과 목적

스코핑은 환경영향평가를 시작하는 단계에서 무엇을 조사하고 평가해야 하는지를 정하는 절차이다. 평가항목과 조사 범위를 미리 설정함으로써 불필요한 조사를 줄이고, 사업의 중요한 환경문제에 집중할 수 있도록 한다. 일본은 1997년 환경영향평가법을 제정하면서 방법서 절차를 처음 도입하였다. 이는 미국과 유럽에서 시행되던 스코핑과 유사한 절차였지만, 당시 일본의 제도는 평가항목과 조사방법을 정하는 데 초점이 맞추어져 있었다.

본 연구는 일본의 방법서 절차를 미국, 네덜란드, 한국의 스코핑 제도와 비교하여 일본 환경영향평가 제도의 개선 방향을 검토하는 것을 목적으로 하였다. 

Background and Objectives

Scoping is the stage of Environmental Impact Assessment in which the issues, alternatives, impacts, and methods to be examined are determined. By establishing the scope of an assessment at an early stage, unnecessary investigation can be reduced and attention can be focused on the most significant environmental issues.

Japan introduced the methods documentprocedure when the Environmental Impact Assessment Act was enacted in 1997. Although this procedure was similar to scoping systems used in the United States and Europe, the Japanese approach at the time focused primarily on selecting assessment items and methodologies.

This study compared Japan’s procedure with the scoping systems of the United States, the Netherlands, and Korea to identify possible improvements to the Japanese EIA system.

연구 방법

일본, 미국, 네덜란드, 한국의 스코핑 제도를 다음 항목을 중심으로 비교하였다. 제도의 법적 근거, 환경영향평가의 수행 주체, 스코핑 단계의 검토 범위, 관련 문서의 명칭, 논의 결과의 공표 방식, 주민과 이해관계자의 참여 방법 등이다.

Research Approach

The scoping systems of Japan, the United States, the Netherlands, and Korea were compared in terms of: legal and institutional basis,  responsible authority or project proponent, scope of issues examined, relevant documents, methods of disclosing the results; and opportunities for public and stakeholder participation.

주요 결과

첫째, 각국의 스코핑 제도는 환경영향평가의 조사 범위를 합리적으로 설정하고 평가의 효율성을 높이려는 공통된 목적을 가지고 있었다.

둘째, 미국과 네덜란드에서는 사업을 시행하지 않는 대안(No Action Alternative)을 포함한 여러 대안의 비교가 스코핑의 중요한 요소로 포함되어 있었다.

셋째, 미국과 네덜란드는 회의와 협의를 통한 쌍방향 정보교류를 실시하고, 스코핑 과정에서 논의된 내용을 문서로 작성하여 공개하는 등 비교적 높은 수준의 주민참여 절차를 운영하고 있었다.

넷째, 일본의 방법서 제도는 주민들이 의견서를 제출할 수 있도록 했다는 점에서 이전보다 발전한 제도였다. 그러나 평가항목과 조사방법뿐 아니라 대안의 비교검토가 함께 이루어져야 하며, 회의 형식의 정보교류를 도입하여 참여 수준을 높일 필요가 있었다.

Major Findings

First, although the specific methods differed among countries, all four scoping systems shared the objective of defining a reasonable scope and improving the efficiency of Environmental Impact Assessment.

Second, in the United States and the Netherlands, comparing project alternatives—including a no-action alternative—was treated as an essential part of the scoping process.

Third, the systems in the United States and the Netherlands provided relatively high levels of participation through meetings, consultation, and two-way communication. The outcomes of scoping discussions were also documented and publicly disclosed.

Fourth, Japan’s methods document procedure represented an improvement because it allowed residents to submit written opinions. However, the study suggested that the process should go beyond selecting assessment items and methods. It should also include the comparison of alternatives and meeting-based communication to strengthen meaningful participation.

연구 배경과 목적

일본에서는 1999년 환경영향평가법이 시행되면서 지방자치단체들도 기존의 환경영향평가 요강과 조례를 대폭 개정하기 시작했다. 2000년 당시 도쿄도를 비롯한 59개 지방자치단체가 자체적인 환경영향평가 제도를 운영하고 있었다.

환경영향평가가 환경을 고려한 의사결정 절차로 기능하려면 제도의 공개성이 보장되어야 한다. 정보공개와 주민참여가 충분하지 않으면 지역주민과의 신뢰와 합의를 형성하기 어렵기 때문이다.

본 연구는 일본의 59개 지방자치단체가 운영하던 환경영향평가 제도를 조사하여, 특히 방법서 단계와 평가서안 단계에서 시행되던 주민참여 절차의 특징을 밝히는 것을 목적으로 하였다. 

Background and Objectives

Following the implementation of Japan’s Environmental Impact Assessment Act in 1999, local governments began revising their existing EIA guidelines and ordinances. By 2000, 59 local governments, including the Tokyo Metropolitan Government, had established their own EIA systems.

For Environmental Impact Assessment to function as a transparent decision-making process, both information disclosure and public participation are necessary. Without openness, it is difficult to build trust or reach agreement with local communities.

This study examined the EIA systems of all 59 local governments, focusing particularly on public participation procedures during the scoping and draft environmental impact statement stages.

연구 방법

환경영향평가 제도를 운영하고 있던 59개 지방자치단체의 환경 담당 부서에 관련 조례와 요강 자료를 요청하여 수집·분석하였다. 각 지방자치단체의 환경영향평가 절차를 다음 단계로 구분하였다.

사전 환경배려 및 스크리닝, 방법서 또는 스코핑, 환경영향평가서안, 최종 환경영향평가서, 사후 환경조사

이 가운데 주민참여가 사업계획과 의사결정에 상대적으로 큰 영향을 미칠 수 있는 방법서 단계와 평가서안 단계를 중심으로 국가 환경영향평가법과 지방자치단체의 제도를 비교하였다.

Research Approach

Relevant ordinances and guidelines were collected from the environmental departments of all 59 local governments operating EIA systems. Their procedures were divided into the following stages:

preliminary environmental consideration and screening, scoping or methods document, draft environmental impact statement, final environmental impact statement; and, post-project monitoring.

The analysis focused primarily on the scoping and draft statement stages, where public participation was considered most likely to influence project planning and decision-making.

주요 결과

첫째, 환경영향평가법 시행에 맞추어 개정된 지방자치단체 조례들은 대체로 국가 환경영향평가법과 유사한 절차를 채택하고 있었다.

둘째, 일부 지방자치단체는 국가 환경영향평가법보다 적극적인 주민참여 절차를 운영하고 있었다. 여기에는 주민의견에 대한 사업자의 서면 답변, 공청회, 추가 주민의견 제출, 설명회 등이 포함되었다.

셋째, 아직 개정되지 않은 일부 환경영향평가 요강에는 방법서 단계가 없거나 주민참여가 제한되는 등 국가 환경영향평가법의 기준에도 미치지 못하는 문제점이 있었다.

넷째, 지방자치단체는 국가 제도를 단순히 적용하는 데 그치지 않고 지역의 특성에 맞는 보다 적극적인 참여절차를 도입함으로써 국가 환경영향평가 제도를 보완할 수 있었다.

Major Findings

First, local government ordinances revised following the implementation of the national EIA Act generally adopted procedures similar to those of the national system.

Second, some local governments introduced more active public participation procedures than those required under the national Act. These included written responses to public comments, public hearings, opportunities for further public submissions, and explanatory meetings.

Third, some unrevised local government guidelines did not include a scoping stage and provided only limited opportunities for participation. In some cases, these systems did not even meet the standards of the national EIA Act.

Fourth, local governments could complement the national system by introducing more participatory procedures suited to local conditions, rather than merely applying national requirements.


두 연구를 통해 확인한 점

두 연구는 각각 스코핑의 국제비교와 일본 지방자치단체의 주민참여 제도를 다루었지만, 공통적으로 다음과 같은 점을 보여주었다.

1. 환경영향평가는 사회적 의사결정 제도이다

환경영향평가는 환경에 미치는 영향을 조사하는 기술적 절차에 그치지 않는다. 조사된 정보를 바탕으로 대안을 검토하고, 이해관계자들이 의견을 나누며, 더 나은 사업계획을 만들어 가는 의사결정 과정이다.

2. 사업 초기 단계의 참여가 중요하다

사업계획이 대부분 결정된 뒤 의견을 듣는 것보다, 스코핑을 포함한 초기 단계부터 주민과 이해관계자가 참여할 때 갈등을 줄이고 보다 다양한 대안을 검토할 수 있다.

3. 대안 검토는 스코핑의 핵심 요소이다

어떤 환경항목을 조사할 것인가뿐 아니라 사업의 규모와 위치, 방식, 사업을 시행하지 않는 대안까지 함께 검토할 때 환경영향평가의 실효성이 높아진다.

4. 정보공개는 참여의 전제조건이다

주민과 이해관계자가 충분한 정보를 제공받고 검토할 수 있어야 실질적인 의견을 제시할 수 있다. 투명한 정보공개는 사회적 신뢰 형성의 출발점이다.

5. 지방자치단체는 국가 제도를 보완할 수 있다

지방자치단체는 지역의 환경적·사회적 특성에 맞는 주민참여 절차를 도입함으로써 국가 환경영향평가 제도의 한계를 보완할 수 있다.

Integrated Findings

Although the two studies examined different subjects—international scoping systems and local government public participation procedures—they shared several important conclusions.

1. EIA is a social decision-making system

Environmental Impact Assessment is not limited to the technical investigation of environmental impacts. It is a process through which alternatives are examined, stakeholders exchange information and opinions, and project plans are improved.

2. Participation must begin early

Participation is more effective when residents and stakeholders are involved from the early planning and scoping stages rather than after major project decisions have already been made.

3. The consideration of alternatives is central to scoping

Scoping should determine not only which environmental factors to study but also which project alternatives should be considered, including location, scale, implementation methods, and the option of not proceeding with the project.

4. Information disclosure is a prerequisite for participation

Residents and stakeholders can make meaningful contributions only when they have access to sufficient information and adequate time to review it. Transparency is the foundation of public trust.

5. Local governments can strengthen the national system

Local governments can complement national EIA requirements by introducing public participation procedures designed to reflect local environmental and social conditions.


연구의 의의

이 두 연구는 환경영향평가 제도를 단순한 조사와 평가의 기술적 틀이 아니라, 대안 검토와 정보공개, 주민참여가 결합된 사회적 의사결정 과정으로 바라보았다는 점에서 의미가 있었다.

스코핑에 관한 국제비교 연구를 통해서는 일본 제도가 대안 검토와 쌍방향 의사소통을 강화할 필요가 있음을 확인하였다. 지방자치단체 연구를 통해서는 국가의 제도보다 발전된 참여절차가 지역 차원에서 운영될 수 있으며, 지방자치단체가 국가 환경영향평가 제도의 한계를 보완할 수 있음을 확인하였다.

이러한 연구 경험은 이후 환경 NGO의 역할, 주민참여, 사회적 합의형성, 그리고 주민수용성에 관한 연구로 자연스럽게 이어졌다.

Research Significance

These studies were significant because they approached Environmental Impact Assessment not merely as a technical framework for investigation and evaluation, but as a social decision-making process integrating alternatives, information disclosure, and public participation.

The international comparison of scoping systems indicated that Japan needed to strengthen both the consideration of alternatives and two-way communication. The study of local government EIA systems demonstrated that local governments could adopt participation procedures more advanced than national requirements and thereby address limitations in the national system.

These research experiences naturally led to my later work on Environmental NGOs, Public Participation, Consensus Building, and Social Acceptance.

Reflection

지금 돌아보면 나는 환경영향평가 제도를 연구하고 있었지만, 실제로는 사람들이 더 나은 결정을 만들어 가는 과정을 연구하고 있었다.

좋은 제도를 만드는 일은 중요하다. 그러나 제도가 존재한다고 해서 반드시 좋은 결정이 만들어지는 것은 아니다. 충분한 정보가 공개되고, 다양한 대안이 검토되며, 주민과 이해관계자가 초기 단계부터 참여할 수 있어야 제도는 비로소 제 역할을 할 수 있다.

스코핑과 지방자치단체의 주민참여 절차를 연구하면서 나는 환경문제의 해결이 기술적인 조사만으로 완성되지 않는다는 사실을 배웠다. 결국 중요한 것은 제도 속에서 사람들이 어떻게 정보를 나누고, 서로 다른 의견을 조정하며, 함께 결정을 만들어 가는가였다.

환경영향평가 제도는 나에게 환경정책을 바라보는 첫 번째 창이었다. 그리고 그 창을 통해 주민참여, 환경 NGO, 사회적 합의형성, 주민수용성이라는 더 넓은 연구의 세계를 만나게 되었다.

돌이켜 보면 내가 오랫동안 연구해 온 것은 제도 자체라기보다, 제도 속에서 함께 살아가고 결정하는 사람들이었던 것 같다.

Looking back, although I believed I was studying Environmental Impact Assessment systems, I was actually studying how people make better decisions together.

Good institutions are important. Yet the existence of a system alone does not guarantee good decisions. A system can function effectively only when adequate information is disclosed, meaningful alternatives are examined, and residents and stakeholders are able to participate from the early stages.

Through my research on scoping and local government participation procedures, I learned that environmental problems cannot be resolved through technical investigation alone. The essential question was how people share information, reconcile different perspectives, and make decisions together within an institutional process.

The EIA system became my first window into environmental policy. Through that window, I encountered the broader research fields of Public Participation, Environmental NGOs, Consensus Building, and Social Acceptance.

Looking back, what I have studied over the years was not simply the system itself, but the people who live, participate, and make decisions within it.
